The rules for using this website, submitting our form, and receiving text messages from us, plus the standard terms that apply when a business engages NRT BPO LLC.
These Terms and Conditions ("Terms") govern your use of the website located at nrtbpo.com (the "Site") and the related forms, communications and text messaging program operated by NRT BPO LLC ("NRT BPO," "we," "us," or "our"). By accessing the Site, submitting a form, or opting in to receive text messages, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Site.
The Site is provided for general informational purposes about NRT BPO and the services we offer. Nothing on the Site is an offer that can be accepted to form a contract; services are engaged only through a signed service agreement.
We work to keep the Site available and accurate, but we make no guarantee that it will be available at any particular time, free of errors, or free of interruptions. We may change, suspend or discontinue any part of the Site at any time without notice.
All content on the Site, including text, graphics, logos, page designs and code, is the property of NRT BPO LLC or its licensors and is protected by copyright, trademark and other intellectual property laws. You may view and print pages for your own business evaluation of our services. You may not copy, reproduce, republish, distribute or create derivative works from Site content without our written permission. You agree not to use the Site in any way that is unlawful, that interferes with its operation, or that attempts to gain unauthorized access to any system or data.
When you submit a form on the Site, you represent that the information you provide is accurate and that you are authorized to provide it. By submitting the form you agree that NRT BPO may contact you by email and by telephone at the contact details you provide, for the purpose of responding to your inquiry, scheduling a consultation and discussing our services. Telephone contact under this section means live calls placed by our staff.
Text messaging is handled separately and requires your affirmative opt-in as described in Section 4. Checking the SMS consent box is optional and is not required to submit the form or to receive a response from us.
Program name. NRT BPO Alerts.
Program description. NRT BPO Alerts is a text messaging program operated by NRT BPO LLC. Messages are sent by our staff to people who submitted our website form, for conversational follow-up on their inquiry, to schedule and confirm consultation calls, to send appointment reminders and service updates, and occasionally to share offers related to our services.
How to opt in. You opt in by checking the SMS consent checkbox on our web form and submitting the form with your mobile number. The checkbox is unchecked by default. By opting in, you agree to receive recurring text messages from NRT BPO LLC at the number you provided.
Consent is not a condition of purchase. Agreeing to receive text messages is not required to purchase any goods or services from NRT BPO LLC, and you can decline SMS consent and still receive a response by email or phone.
Message frequency. Message frequency varies based on your inquiry and the conversation.
Cost. Message and data rates may apply. Check with your mobile carrier for details about your plan.
How to cancel. Text STOP to any message from us at any time to cancel. You will receive one final message confirming that you have been unsubscribed, after which you will receive no further messages unless you opt in again.
How to get help. Text HELP to any message from us for assistance, or email info@nrtbpo.com.
Carriers. Wireless carriers are not liable for delayed or undelivered messages. Delivery is subject to effective transmission from your carrier and to your device's compatibility.
Your mobile information. Our handling of mobile numbers and opt-in data is described in the SMS / Text Messaging section of our Privacy Policy. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes.
Changes to the program. We may modify or cancel the program or any of its features at any time. If we make material changes, we will update these Terms.
This Section 5 applies only to businesses that engage NRT BPO LLC to provide services (each a "Client"). It sets out our standard terms. Where a signed service agreement between NRT BPO LLC and a Client says something different, the signed service agreement controls.
Unless the service agreement states otherwise, engagements run month-to-month. Either party may end the engagement by giving the other at least thirty (30) days' written notice. Fees for services performed through the end of the notice period remain payable.
Fees are as stated in the service agreement. Invoices are due on receipt. We may suspend services on accounts with invoices that remain unpaid after written notice.
Each party will keep confidential the non-public business, technical, customer and personal information it receives from the other in connection with the engagement, will use it only to perform or receive the services, and will protect it with at least the care it uses for its own confidential information. This obligation continues after the engagement ends. It does not apply to information that is publicly available, independently developed, or required to be disclosed by law, provided the disclosing party is given notice where lawful.
Specialists, client directors and other personnel assigned to a Client's account remain employees or contractors of NRT BPO LLC at all times. They are not employees, agents or contractors of the Client, and nothing in the engagement creates an employment relationship between the Client and any NRT BPO personnel. NRT BPO is responsible for their compensation, supervision and management.
The Client is responsible for the legality, accuracy and appropriateness of all scripts, call lists, contact data, instructions, systems access and materials it provides to NRT BPO, including any consents required to contact the individuals on lists the Client supplies. The Client will comply with all laws applicable to its business and to the work it directs us to perform, and will promptly tell us of any legal or regulatory requirement that affects how the services should be carried out.
NRT BPO provides customer support, sales, back-office and staffing services. We do not provide legal, tax, medical, insurance or credit advice, and our personnel follow the scripts and instructions approved by the Client. We make no guarantee of specific results, including any particular volume of leads, appointments, sales, collections or outcomes.
To the fullest extent permitted by law, NRT BPO LLC's total liability to a Client arising out of or relating to the services, under any theory, will not exceed the fees paid by that Client to NRT BPO LLC in the three (3) months immediately preceding the event giving rise to the claim. Neither party will be liable to the other for indirect, incidental, consequential, special or punitive damages, or for lost profits or lost business, even if advised of the possibility. These limits do not apply to a party's breach of confidentiality or to liability that cannot be limited by law.
The service terms and any dispute arising out of the services are governed by the laws of the State of Texas, without regard to its conflict-of-laws rules. The parties agree to the exclusive jurisdiction and venue of the state and federal courts located in Harris County, Texas.
The Site and its content are provided "as is" and "as available," without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement. To the fullest extent permitted by law, NRT BPO LLC will not be liable for any damages arising out of your use of, or inability to use, the Site. Any client quotations or descriptions of past work on the Site reflect individual experiences and are not a promise of similar results.
We may revise these Terms from time to time. Revisions take effect when posted on this page, and the effective date above will be updated. Your continued use of the Site after a revision takes effect means you accept the revised Terms.
